These Terms govern your use of the GameBag app and website, which are operated by Symbiotic Solutions ("we," "us"). By creating an account or using GameBag, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use GameBag.
1. Eligibility and your account
- You must be at least 13 years old. If you are under the age of majority where you live, you need a parent's or guardian's permission.
- Give accurate information and keep your password secure. You're responsible for activity on your account.
- One person per account. Don't impersonate anyone or create accounts to evade a suspension.
2. Your content
You own the photos, logs, comments, and other content you post. You give us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and adapt that content as needed to operate and improve GameBag and to show it to the audience you choose. This license ends when you delete the content or your account, except for copies other users have already reshared or that remain for a limited time in backups.
You promise you have the rights to what you post, and that it doesn't violate these Terms or anyone else's rights.
3. Community rules (zero tolerance)
We have no tolerance for objectionable content or abusive users. You may not post or do any of the following:
- Harassment, threats, bullying, hate speech, or content that demeans people based on a protected characteristic
- Sexual content or nudity, or any content involving minors in an unsafe or sexualized way
- Gratuitous gore. Photos of lawfully harvested game are fine; cruelty to animals is not
- Evidence of, or encouragement of, poaching, trespassing, or any other illegal take or activity
- Sale or trade of firearms, ammunition, wildlife, or wildlife parts
- Spam, scams, or misleading content, or impersonation of others
- Other people's private information, such as addresses or precise locations, without their consent
- Infringement of someone's copyright, trademark, or other rights
- Attempts to access accounts or data that aren't yours, interference with the service, scraping, or reverse engineering, except where the law allows
Reporting and blocking. In the app, tap ⋯ on any post or profile, or long-press a comment, to Report it or Block the user. Blocked users can't see your content or contact you, and you won't see theirs. You can also email support@gamebagusa.com with the username and a description or screenshot. We review every report within 24 hours. We may remove content, and suspend or ban accounts, that violate these rules.
4. Hunt and fish legally and safely
GameBag is a logbook and social app. It is not a source of legal, regulatory, or safety advice. Species lists, seasons, slam definitions, and other information in the app may be incomplete or out of date. You are solely responsible for knowing and following all hunting, fishing, firearm, licensing, bag-limit, and property laws where you are, and for your own safety and the safety of others.
5. Our service
- GameBag is provided free of charge. We may change, add, or remove features, show sponsored content, or stop offering the service.
- We may suspend or terminate access if you violate these Terms or if it's needed to protect users or the service.
- You can stop using GameBag and delete your account at any time. See Delete Account.
6. Disclaimers
GameBag is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that the service will be uninterrupted or error-free, or that content, including content posted by other users, is accurate.
7. Limitation of liability
To the fullest extent permitted by law, Symbiotic Solutions and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of GameBag. Our total liability for any claim relating to GameBag is limited to $50. Some jurisdictions don't allow these limits, so they may not fully apply to you.
8. Indemnity
You agree to defend and indemnify us against claims, losses, and expenses, including reasonable attorneys' fees, that arise from your content, your use of GameBag, or your violation of these Terms or the law.
9. App stores
If you downloaded GameBag from the Apple App Store or Google Play, these Terms are between you and us, not Apple or Google. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. Apple has no obligation to provide maintenance or support for the app. Your use must also comply with the applicable store's terms.
10. Changes and general terms
We may update these Terms. If we make material changes, we'll update the effective date and, where appropriate, notify you in the app. If you keep using GameBag after the changes take effect, you accept them. These Terms are governed by the laws of the United States and the state in which Symbiotic Solutions is organized, without regard to conflict-of-law rules. If any provision is unenforceable, the rest remain in effect.
